Tysvær municipality intends to enter into a ten year hire contract for town hall purposes with Aksdal Handelssenter AS, organisation number 924 352 248. The rent object shall be located in Aksdal in Tysvær municipality. The rent contract includes a unilateral option for Tysvær municipality to extend the hire period if the municipal council, after 10 years, considers it appropriate. The lease agreement is pursed in I FOA S 2-4 letter a), in which there is an exception from the Procurement Act and the regulations for "acquisition or hire of land, existing buildings or other real estate or rights to such property", case law states that the exception can be interpreted expanding, after a concrete assessment so that future buildings can also be included, e.g. KOFA case 2012/58, refer to case C-451/08 and case C-215/09 from the Court of Justice of the European Union. "Based on the Committee ́s assessment, the exception in the regulations is basically not limited to the acquisition or hire of buildings that exist at the time of the agreement."
